General

The terms & conditions of this agreement apply to all users of Nolimit Voip website, Nolimit software, services, devices and any other items provided by NO LIMIT. If you do not agree to all Terms and Conditions you should not use Nolimt Voip’s website and services, nor download, install or use Nolimit’s software, nor use Nolimit’s VoIP services. We make this Website available and offer our products and services based on the terms and conditions set below. By using this Website and purchasing products or services from us, you agree to the terms and conditions.

These terms and conditions apply to the Nolimit VoIP service (the "Service"). Please read this agreement (the "Agreement") before using the service in whole or in part. In this agreement, "We" or "Us" relates to Nolimit or their agents and "You" or "Customer" relates to the person, person(s) or organisation receiving the Service. We have provided the customer with this agreement for the purpose of informing you of your rights and obligations in subscribing to and using No Limit residential and business VOIP service. We may amend the terms and conditions at any time. Customers should check this page on a regular basis to keep up to date with any amendments or changes that occur.

This service may be purchased by the customer from Nolimit Voip service by signing up for, paying for, activating or using our Voip telephony service, you acknowledge that you have read and understood, and you agree, to the terms and conditions of this Agreement, and you represent that you are of legal age to enter this Agreement and become bound by its terms. We can cancel it or take corrective action at anytime without prior notice and for any reason, including, but not limited to, your violation of any of these terms and conditions.

The service will NOT work without the customer having working Internet access with a high-speed connection. The service will NOT work over a dial up connection. The higher speed the connection the better the service will generally work. You acknowledge that although we will take all reasonable steps to make sure you receive the voice service within the local calling areas, the voice service is not free from faults or interruptions. Certain factors, such as network congestion, maintenance, technical capabilities, geographic factors, obstructions or interference may mean you will not receive the voice service at certain times.

Description of Products and Services Offered

Nolimit uses this Website to offer local, long-distance and international calling services. The Calling Services are offered exclusively on a prepaid basis. You may purchase Calling Services with a specified value, and you may use the Calling Services using a standard SIP software or hardware by using the number provided to you and by entering your password to identify your Nolimit account. Nolimit may also offer other products and services from time to time, which will also be governed by the terms of this Agreement, unless otherwise indicated. A list of Nolimit products and services can be found on the Website.

Service will be offered on a monthly basis for a term which begins on the date that Nolimit activates your service and ends on the day before the same date in the following month. If you want to discontinue your Service, you must give us notice by emailing the Nolimit and requesting a disconnection. A confirmation of disconnect email will be sent by return email and the service will be disconnected within 7 days. The confirmation email is your proof that we have received your cancellation request. If you are purchasing the service for full monthly terms, meaning that if you attempt to terminate the service prior to the end of a monthly term, you will be responsible for the full month's charges to the end of the then-current term, including without limitation unbilled charges, plus a cancellation fee, all of which immediately become due and payable. Expiration of the term or termination of service does not excuse the Customer from paying all unpaid, accrued charges due in relation to the Agreement.

Opening an Account

You agree that the information you supply during the registration process is true, accurate and complete and that you will not register under the name of another person. You will be responsible for preserving the confidentiality of your chosen password and will notify Nolimit of any known or suspected unauthorized use of your account. You agree to keep Nolimit informed of any change in the information you provided at the time of your initial registration.

You agree to indemnify, defend and hold harmless Nolimit, its affiliates, and their officers, directors, employees, agents, licensors and suppliers, from and against any and all liabilities, fines, losses, expenses and damages resulting from the supply of any information during the registration process which is not true, accurate and correct or arising from your failure to update such information as required or from any activity related to your account including negligent or wrongful conduct by you or any other person accessing your Nolimit account.

In order to purchase Calling Services, you must complete in full an application form on the Website, provide a valid credit card number or other permitted payment method, select a non-refundable, specified dollar value of Calling Services you wish to purchase and, specify the type of Calling Services you are purchasing. All transactions are in AUSD. For transaction security we use SSL encryption. Your credit card will be billed immediately after purchase. Following completion of your purchase, you will be sent an electronic notification (in the form of an e-mail message), which will state the value of the Calling Services you purchased. We recommend the cardholder to print out all transaction data, the terms and conditions and the payment methods in order to avoid misconceptions and discussions at a later time. Nolimit will establish an account to track the service value you are entitled to receive.

Call Charges

You can review Nolimit’s charges for its services at our rates page, call charges are shown per minute, billed per minute. Nolimit only charges for answered calls and ceases to charge when the call is terminated by the caller. Timed calls are calculated using the total network time used for each call. We reserve the right to increase the prices of its services and may vary its charges from time to time without prior notice to you. We also reserve the right to offer special promotions at any time. While our goal is to maintain consistent and competitive rates on all Calling Services, we cannot guarantee that rates will not be altered significantly before you use the Calling Services purchased, which could significantly affect the amount of Calling Services you are entitled to. You have the right to review, correct and cancel a purchase of credit before confirming a transaction and to have a purchase refunded within seven up to fourteen days of concluding a transaction where you have not already commenced using the service.

You are entirely responsible for any and all activities that occur on your Nolimit account and you shall be strictly liable for all charges debited against your account whether or not these charges are incurred by you or any other person, authorized or unauthorized, intentionally or unintentionally, or as a result of any virus, hack or security breach.

Billing Information

You must provide us with a valid credit card number (MasterCard, Visa, Debit Card, American Express or any other issuer then-accepted by NoLimit when the Service is activated. NoLimit reserves the right to stop accepting credit cards from one or more issuers. If the card expires, you close your account, your billing address changes, or the card is cancelled and replaced owing to loss or theft, you must advise NoLimit at once. Fees and charges applicable to your service will commence from the date of connection to NoLimit. We will email an invoice to you no less frequently than monthly, and you must pay these fees and charges by the invoice due date, or next business day. All fees and charges will be billed to your nominated credit/charge card. If you cancel your credit/charge card authority, or if you do not pay your invoice by the invoice due date, No Limit will charge a fifteen dollar late fee. Charges for archive or hardcopy invoices may apply. No Limit can decide that you have a credit limit. If so, we will tell you what that credit limit is. If you exceed the credit limit, we may suspend the service until you pay all call charges owing on your account. Finally, we may ask you to pay a deposit for some or all of the service charges in advance, in order to receive or continue receiving your service. You are still required to pay us your monthly charges by the invoice due date.

Billing Disputes

You must notify NoLimit by calling within 7 days after receiving your credit card statement if you dispute any NoLimit charges on that statement or such dispute will be deemed waived. Billing disputes should be notified by calling the following Customer Care Hotline:1300 338 802

Lawful use of Service and Device

You agree to use the Service and Device only for lawful purposes. This means that you agree not to use them for transmitting or receiving any communication or material of any kind which would constitute a criminal offence, give rise to a civil liability, or otherwise violate any local, national or international law. Nolimit reserves the right to terminate your service immediately and without advance notice if Nolimit believes that you have violated the above restrictions, leaving you responsible for the full month's charges to the end of the current term, including unbilled charges, plus a cancellation fee, all of which immediately become due and payable and may at Nolimit discretion be immediately charged to your credit card. You are liable for any and all use of the service by yourself and by any person making use of the service provided to you. You agree to indemnify and hold harmless Nolimit against any and all liability for any such use.

Service Failure

You acknowledge and understand that the Service does not function in the event of power failure. You also acknowledge and understand that the Service requires a fully functional broadband connection to the Internet and that, accordingly, in the event of an outage of, or termination of service with your Internet service provider (ISP) and/or broadband provider, the Service will not function, but that you will continue to be charged for the Service unless and until you or Nolimit terminates the Service in accordance with this Agreement. Should there be an interruption in the power supply or ISP outage, the Service will not function until power is restored or the ISP outage is cured. A power failure or disruption may require the Customer to reset or reconfigure equipment prior to utilising the Service. Should Nolimit suspend or terminate your broadband Service, the Service will not function until such time as Nolimit restores your Service.

The Service and Device and any software used to provide the Service or provided to you in conjunction with providing the Service and all Services, information, documents and materials on Nolimit website are protected by trademark, copyright or other intellectual property laws. The contents of the Service, including, but not limited to text, photographs, graphics, video and audio content is protected by copyright as a collective work or compilation under the copyright laws of Australia and other countries, and owned or controlled by , their affiliates or the party credited as the provider of the Content. All individual articles, content and other elements comprising the Content are also copyrighted works. You must abide by all additional copyright notices or restrictions contained in the Service. You may not copy, reproduce, distribute, publish, enter into a database, display, perform, modify, create derivative works, transmit, or in any way exploit any part of the Service. The Nolimit service may not be resold or otherwise resupplied by any account holder to any other person or entity without Nolimit prior written consent.

Termination of Service

Nolimit Voip Solutions reserves the right to terminate your Service, at any time. If Nolimit terminates your Service for any stated reason, including violation of this Agreement, or because of any improper use of the Service or Device such as, but not limited to, your attempts to hack, disrupt, or misuse the Service. You will be responsible for the full month's charges to the end of the current term, including unbilled charges, all of which immediately become due and payable.

Limitation of Liability

IN NO EVENT SHALL NO LIMIT, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES OR AGENTS OR ANY OTHER SERVICE PROVIDER WHO FURNISHES SERVICES TO CUSTOMERS IN CONNECTION WITH THIS AGREEMENT OR THE SERVICE BE LIABLE FOR ANY DIRECT, INCIDENTAL, INDIRECT, SPECIAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES, OR FOR ANY OTHER DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE OR PROFITS, OR DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SERVICE, INCLUDING INABILITY TO BE ABLE TO ACCESS EMERGENCY SERVICE PERSONNEL THROUGH THE SERVICE. THE LIMITATIONS SET FORTH HEREIN APPLY TO CLAIMS FOUNDED IN BREACH OF CONTRACT, BREACH OF WARRANTY, PRODUCT LIABILITY, AND ANY AND ALL OTHER THEORIES OF LIABILITY.

Disclaimer of warranties

You expressly understand and agree that your use of the Service is at your sole risk. Nolimit DOES NOT MAKE ANY WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, WITH REGARD TO THE MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE WITH REGARD TO ANY SERVICE, PRODUCTS OR MATERIALS PROVIDED PURSUANT TO THIS AGREEMENT.

Nolimit makes no warranty that its products or services, including the Calling Services, will meet the needs of any particular Customer, or will be uninterrupted, timely, secure or error-free. There may be delays, omissions, interruptions, loss of data and inaccuracies in the service, information provided by the service or other materials available through the service. Nolimit is not responsible for reimbursements for calls made with another service while our services are temporarily unavailable.

You understand that the use of Internet applications may subject a user to various risks including the exposure of sensitive or confidential information to persons for whom it was not intended, hacking, viruses, exposure to contaminated files and objectionable material, spamming, electronic fraud and other security risks. You agree that Nolimit shall not be responsible or liable for any intrusion or hack to the Software nor for any unauthorized access to the information or data stored or communicated by you or any other person using the Software or the services of Nolimit or any of its partners, affiliates or third party service providers and it is your own responsibility to ensure that that only authorized persons have access to such information or data through adequate information security standards and procedures to be implemented and monitored by you. You furthermore agree to be bound by the terms of Nolimit's privacy policy. Nolimit does not guarantee the non-exposure of your personal information or IP address. Notwithstanding the terms of Nolimit’s privacy policy, you assume the risk of any breaches of privacy. All customer data will be treated confidential and will not be sold to others.
